Virtual Home Energy Check-Up Terms & Conditions

The Virtual Home Energy Check-up (the “Program”) is administered in whole or in part, by City Green Solutions (“City Green”), the City of North Vancouver (“CNV”), District of North Vancouver (“DNV”), and the District of West Vancouver (“DWV”), together the “Administrators”, and in collaboration, from time to time, with additional third-party contributors (each, a “Collaborating Party”). Eligible participants who are approved to participate in the Program may access benefits as defined in these Terms and Conditions (collectively, the “Benefits”).

The Virtual Home Energy Check-Up is being offered as part of the Jump on a Heat Pump Program administered by the DNV, CNV, and DWV.

The Program Terms and Conditions are effective October 4, 2021 until funds are exhausted.

General Eligibility

1. To access Benefits under the Program, each applicant and each Benefit must satisfy the eligibility and other requirements set out in these Terms and Conditions (each eligible applicant is referred to as a “Participant”). The eligibility criteria of premises (the “Premises”) are as follows:
   • Participants must be owners of a home within the City of North Vancouver, District of North Vancouver, or the District of West Vancouver.
   • Each Participant must submit a separate Virtual Home Energy Check-Up Intake Form per Premise.
   • The Premise must be connected to a current residential utility service account with FortisBC Inc., and/or BC Hydro.
   • The Premise must be heated primarily by natural gas supplied by FortisBC Inc. or heated by electricity (hard-wired electric heating systems such as electric baseboards, radiant ceiling, radiant floors, or forced-air furnace) supplied by BC Hydro or heated primarily by oil, propane, or wood. A primary heating system is a heating system with the capacity to heat a minimum of 50% of the home for the entire heating season to 21ºC. Determination of the primary heating type is at the sole discretion of the Program. A fireplace is not eligible as a primary heating system.
2. The following types of premises are eligible for the Program:
   • single family detached dwelling;
   • single family detached dwelling with a secondary suite that is individually metered;
   • mobile home that is permanently fixed, sits on a foundation, structurally complete with installed and connected plumbing, heating, electrical, water and sewer services with towing apparatus and axle has been removed; or
   • side-by-side or stacked duplex or side-by-side row home or townhouse, provided each unit has its own natural gas and/or electricity meter. Utility accounts in the name of a strata corporation are not eligible.
3. The following types of premises are not eligible for the Program
   • multi-unit residential buildings such as condominiums, high-rises and apartment buildings;
   • stacked townhomes;
   • vacation homes or premises that are not year-round primary residences;
   • garages, workshops, and outbuildings; and
   • Newly constructed buildings or a new addition to an existing building. An existing space, such as a garage or solarium, being converted into a living space is considered a new addition.
4. Premises must be at least 12 months old.

Virtual Home Energy Check-Up

1. Participants must submit the Virtual Home Energy Check-Up Intake Form to access the Program.
2. A Virtual Home Energy Check-up consists of a phone-based or software-based check-up of up to 1 hour maximum to discuss items identified in the Virtual Home Energy Check-Up Intake Form with an Energy Expert.
3. The Virtual Home Energy Check-Up can be accessed a maximum of 2 times per Premise.
4. The Virtual Home Energy Check-Up can be rescheduled 2 times before the request is cancelled. Cancelled requests count towards the per Premise limit.
5. The Virtual Home Energy Check-Up is a limited quantity offer and available first come, first served until funds are exhausted.

General terms and conditions

1. The Program reserves the right to revise the Program Terms without notice, including but not limited to revisions to Benefits and eligibility requirements.
2. Decisions of the Program are final and binding and not subject to appeal. The Program may provide reasons for their decisions but are under no obligation to do so.
3. The Program reserves the right, without incurring any liability, to reject Virtual Home Energy Check-Up requests, applications, or registrations to the Program that it determines, in its sole discretion, are incomplete, inaccurate, or otherwise do not meet applicable Program requirements. A Program application or registration will be considered incomplete if it is missing required documents, information is incomplete, or if the Program requests additional details.
4. If a Program application or registration is received incomplete, the Program may void the application or registration if the Participant fails to provide a fully completed application or registration within ten business days after receiving a request to do so by the Program.
5. Participants are responsible for meeting all Program requirements and ensuring that if products are installed, that they are installed in accordance with all applicable laws, orders, ordinances, standards, codes and other rules, licenses, and permits of all lawful authorities, and in accordance with manufacturer’s specifications.
6. Participants must ensure appropriate products and installation techniques are used that do not compromise their Premises’ structure, indoor air quality and safety.
7. Participants are solely responsible for meeting all Program requirements.
8. The Program does not endorse any specific product, retailer, Energy Advisor or contractor, and are not liable for the Participant’s selection of materials or products, or the workmanship, operation, performance or warranty associated with any Benefits or associated work performed, whether by a contractor, Energy Advisor, or otherwise, in relation to the Program. The Program makes no representation or warranty, whether express or implied, in respect of any product, materials, services or measures associated with any Benefits accessed in relation to the Program, or with respect to the energy consumption figures or energy-efficiency recommendations included in any EnerGuide home evaluation. Actual energy consumption and costs depend on a host of factors beyond the control of Natural Resources Canada (NRCan) and the Program.
9. The Program does not guarantee, and accepts no liability for, the level of energy savings achieved by a Participant under this Program.
10. The Program and its Collaborating Partners are not responsible under any circumstances whatsoever for the actions, omissions, recommendations or advice of any contractor or Energy Advisor engaged by a Participant in connection with the Program.
11. Participants hereby agree to indemnify and save harmless the Program, its Collaborating Partners, and their respective directors, officers, agents and employees from all liability, damages, claims, demands, expenses, and costs for claims, costs for injury or death of any person, damage to or destruction of property and all economic loss suffered by any person arising from or occurring by reason of the Program, receipt of a Benefit(s) or actual or alleged preparation, installation or use of the Benefit(s), including any actions or omissions by third-party consultants or contractors in the preparation or delivery of the Benefits(s).
12. The Program, including its Program Terms, are governed by and interpreted in accordance with the laws of the Province of British Columbia.

Access and use of personal information and protection of privacy

1. The Program and its Collaborating Partners are collecting, using and disclosing the personal information on the Program application and registration materials for the purpose of administering the Program, evaluating the effectiveness of the Program, and undertaking analysis and research to inform changes to existing programs and the design of new energy-efficiency programs.
2. The Program and its Collaborating Partners collect, use and disclose personal information in accordance with provisions of the Freedom of Information and Protection of Privacy Act (“FOIPPA”) and its Privacy Policy (which is located at www.jumponaheatpump.ca/privacy-policy). The Program’s collection, use and disclosure of the personal information on application and registration forms is undertaken in furtherance of the Program’s climate action mandate. If Participants have any questions regarding the information collected on the Program registration or application forms, they are invited to call the Virtual Home Energy Check-Up administrators at 250-381-9995.
3. By submitting the Virtual Home Energy Check-Up Intake Form, the Participant consents to:
   • the disclosure of their personal information, as provided by the Participant in any Program application or registration materials, to the Program, the Administrators and any Collaborating Party and their respective affiliates and contractors, for the purposes of administering the Program, evaluating the effectiveness of the Program and undertaking analysis and research to inform changes to existing programs and the design of new energy-efficiency programs;
   • specifically with respect to the EnerGuide home evaluations, the disclosure of their personal information to NRCan, the Program and any Collaborating Party for the purposes of administering the Program, evaluating the effectiveness of the Program and undertaking analysis and research to inform changes to existing programs and the design of new energy-efficiency programs. The Participant hereby authorizes the Program and Collaborating Parties to collect this information indirectly through NRCan and/or the Energy Advisor, knowing that all parties must, at a minimum, safeguard the Participant’s information according to information protection standards under applicable federal and provincial privacy legislation;
   • upon request by NRCan, the disclosure of any of the above-listed information (including personal information) to NRCan; and
   • be contacted by the Program (or their authorized agents) by phone, email, direct mail or similar method for the purposes of administering, evaluating and researching all elements of the Program for up to three years after the end of the Program.
